Abstract

The Dissertation is devoted to the development of theoretical foundations and practical scientifically based proposals aimed at improving the practice of professional and psychological training of lawyers focused on the formation and development of lawyer’s creative thinking settings. The peculiarities, structure, content, levels, specific feature of lawyer’s cognitive activity is characterized; it is also proved that the creative character of law activity is one of its main peculiarities. The concept of creativity as a component of cognitive process is defined. Various definitions of the term "creativity", the main areas of the term research, the most important approaches to its study and its characteristics are presented. Factors, conditions of development and psychological determinants of creativity are shown. Individual psychological mechanisms of personality that contribute to the activation of creative thinking in the process of solving cognitive tasks are pointed out. It is stated that she readiness for actualization of creative potential is specified due to appropriate psychological settings.The content of psychological setting and its role in formation of the lawyer’s creative thinking are revealed. The leading psychological determinants of forming the readiness to activate lawyer’s creative thinking are determined. The task to form the setting to use the creative potential is revealed. Educational and developmental activities aimed on motivational, cognitive and behavioural components of the lawyer’s personality are defined. The author's "Training on formation of a creative lawyer’s potential" is shown and the analysis of its effectiveness is carried out, whereby the objectives, functions, structure, requirements, principles and guidelines for its use are described.
