Abstract

The article is devoted to the problems of defining the essence, features and specifics of legislative support for the management of transformation processes in general secondary education institutions. The author analyzes the constitutional, legislative, regulatory and legal levels of ensuring the management of transformation processes in secondary schools. The author emphasizes that modern systemic strategic management of general secondary education institutions will be successful if there is an effective union of unity of policy with spirituality and morality. This is possible provided that the integrity of spiritual, moral (natural), natural and legal laws is ensured and that the regulation of relations in the field of education, education of future generations of the Ukrainian people, and the transmission of value principles and orientations to them through legal laws has been going on for more than a millennium. At each stage of its development, Ukrainian society has faced the problem of understanding the essence, features and specifics of transformation processes and projecting them into the legal plane by preparing, developing, drafting (formulating) the relevant law, discussing, agreeing and adopting it by the legislative body (or other authorized entity) and giving it legal force, with the definition of the relevant conditions for its operation and implementation. The cementing basis of Ukrainian legislation is the national scientific philosophical, legal, and educational School, which is European, self-sufficient, original and comprehensive. In this case, it is important to have a real and responsible political desire to unify the lawmaking process, to develop common standards, technology and requirements for identifying leading ideas, the system of preparation and procedure for adopting laws. The leading ideas of Ukraine's current legislation in the field of education are to create conditions for the realization of the guaranteed equal right of Ukrainians to high-quality modern scientific, free, accessible scientific education, acquisition of competencies and formation of professionalism. The desire to accelerate the process of Ukraine's accession to the European Scientific, Educational, Information and Intellectual Space requires taking into account the following: each state is trying to protect the rights and interests of its residents; there is no single rational model of legislation in the world and Europe; it is important to ensure equal coexistence of diverse national systems of legislation and forms of legislative process in different countries. It is especially important to develop and practice a democratic, stable lawmaking technology that complies with the provisions of the Constitution of Ukraine, decisions, recommendations, and guidelines of the Constitutional Court of Ukraine and not to subject it to changes. That is why the problem of determining the essence, features and specifics of legislative support for the management of transformation processes in general secondary education institutions is defined as a strategic, defensive, protective, state-building problem centered on the rights, freedoms, will, expression of will, desires, aspirations and opportunities of a creative gifted personality.
