Abstract

Article is devoted to the problem of legal competence of teachers of vocational education institutions concerning the implementation of jurisdictional form of copyright protection. Defined triad powers: possession, use and disposal of intellectual property. Paid attention to the scientific and legislative definition of intellectual property, as the law which protects the moral and economic rights of authors and their successors, related to the creation and use of science, literature, art, etc.., And the rights of performers, producers of phono-and video recordings and broadcasting organizations - entitlements. Disclosure of Art. 50 of the Law of Ukraine "On Copyright and Related Rights", which states that a person has committed acts that violate the moral rights of copyright and / or related rights and their property rights is an offense. The attention is focused on the content of art. 55 of the Constitution, which establishes the right to defense, including intellectual property, as an opportunity to defend any person not prohibited by law. A content analysis of art. 15 of the Civil Code, which states that everyone has the right to defend their civil rights in the event of a breach, the non-recognition or contesting. Defined forms of jurisdictional protection of copyright and related rights: termination of violating law; restore the situation that existed prior to the violation, property damages, compensation for moral (non-property) damage. Substantiated that the legal competence of teachers of vocational schools in the field of intellectual property - a systemic education, integrating a knowledge of rights, duties and responsibilities, the ability to pick up the jurisdictional means of protecting copyright, design abilities of claims, complaints, appeals, appeals experience of interaction between subjects related rights, as personal qualities that make a successful solution of legal problems that arise in professional and educational activities.
