Abstract

The article comprehensively explores the role of mediation as an institution of alternative dispute resolution in forming a culture of dialogue and strengthening the social cohesion of territorial communities in Ukraine under conditions of decentralization and full-scale military aggression. The relevance of the study is driven by the need to find effective mechanisms for the peaceful resolution of conflicts and the restoration of the social fabric of Ukrainian society. The regulatory and legal framework of mediation in Ukraine is analyzed, specifically the provisions of the Law of Ukraine "On Mediation" dated November 16, 2021, No 1875-IX, Directive 2008/52/EC of the European Parliament and of the Council on certain aspects of mediation in civil and commercial matters, and Recommendation CM/Rec(2018)8 of the Committee of Ministers to member States concerning restorative justice in criminal matters. The compliance of domestic legislation with European standards in the field of alternative dispute resolution is established. Theoretical approaches to understanding mediation as a social phenomenon from the perspectives of law, sociology, psychology, and philosophy are examined. Particular attention is paid to the transformative mediation model of R. Bush and J. Folger, which emphasizes two key components: empowerment and recognition. Facilitative and evaluative models are also analyzed, and their advantages and spheres of application are defined. The relationship between mediation practices and the formation of community social capital is investigated based on the concepts of R. Putnam and F. Fukuyama. It is substantiated that mediation promotes the formation of both bonding and bridging social capital through establishing communication, strengthening trust, and developing skills for constructive dialogue. The impact of mediation on the social cohesion of communities, their resilience to external challenges, and their capacity for collective action is analyzed. The peculiarities of applying mediation in various spheres of public life are analyzed: family relations (with an efficiency of 70–80% in common law countries), the educational environment (peer mediation, adult mediation, comprehensive approach), community conflicts during the decentralization process, and restorative justice (taking into account the restorative justice program involving minors approved on July 22, 2024). Special attention is given to the role of mediation in the context of Ukraine's post-war recovery: establishing a national dialogue between internally displaced persons and host communities, reintegrating de-occupied territories, and developing trauma-informed mediation. The prospects for the development of mediation practices related to the integration of mediation into the judicial system, the training of qualified mediators, the development of online mediation, and the popularization of mediation through the free legal aid system are defined.
