Abstract

The article analyzed the official documents of Ukraine that in the last decade of the 20th century became the basis of regulatory support for the functioning the special secondary schools for children and adolescents who need special educational conditions. Since 1995, these schools became known as «social rehabilitation schools». In accordance with the Criminal Code of Ukraine (1960), the court could decide on the possibility not to apply criminal punishment to a juvenile offender. In this case, the court applied the coercive measures of educational influence on the juvenile offender defined by the Code. The most stringent measure of educational influence for juvenile offenders aged 11 to 14 years inclusively was to send them to a special comprehensive school for children and adolescents who need special educational conditions (hereinafter referred to as «special school»). After Ukraine gained independence (1991), the process of revising the regulatory framework for the functioning of various types of educational institutions began. So, in 1993, the Cabinet of Ministers of Ukraine adopted a decree "On the organization of the activities of special educational institutions for children and adolescents who need special educational conditions." The pedagogical teams of these schools were faced with the task of social rehabilitation of the so-called «difficult adolescents», the offenders. They needed to foster an understanding of common human values, citizenship and carry out legal education. It was necessary to prepare them for practical work. Pedagogical influence under such young people should have been provided by both a special daily routine and a system of educational and upbringing lessons. It was necessary to ensure continuous monitoring of the activities of such youth, to exclude the possibility of freely leaving the school without permission from the administration. In accordance with the national program “Education” (“Ukraine of the 21st Century”) (1993), one of the principles of reforming the educational system in Ukraine was its humanization. The humanization process, in particular, was promoted by the adoption of the Law of Ukraine «On the bodies and services for the affairs of adolescents and special institutions for adolescents» (1995). According to this document, the special school not only changed its name, but also received new functional tasks. The idea of “rehabilitating of the offender” changed the concept of creating such living conditions for them, which, although in some way limit the adolescent's rights, do contribute to the development of their personality.
