Abstract

The article analyzes the legally established organizational and legal conditions of state-public management of educational institutions on the basis of partnership interaction in the main regulatory and legal documents on education: the Constitution of Ukraine, the State National Program “Education” (“Ukraine of the XXI Century”), the National Doctrine of Education Development of Ukraine in the 21st Century (2002), the National Strategy for the Development of Education in Ukraine for 2012- 2021, the Law of Ukraine “On Education” (2017) – regarding the consolidation of opportunities for the practical implementation of models of state-public management of education on the basis of partnership interaction. It has been established that in the modern conditions of development of independent Ukraine, the role of the state changes significantly: it becomes a democratic regulator of social relations, a guarantor and defender of the interests and rights of every citizen. Its main functions are regulatory and protective, based on the principle: the state for man, not man for the state. It was found that the structures of public self-government have only the right of an advisory vote. It has been established that in no text of the articles, analyzed documents, partnership interaction between subjects of state and public administration is declared or prohibited directly, only the necessity is declared involving the public, combining the rights of the individual, society, etc.; the mechanisms for involving representatives of civil society, public and private structures in the management of education and educational institutions have not been developed; there are no mechanisms for the implementation of state-public management of institutions of general secondary education on the basis of partnership interaction; despite the attention to the issues of autonomy in the mentioned documents, the mechanisms of its implementation are not defined by legislation. The perspectives and priority directions of the organizational and legal conditions for the development of state-public management of general secondary education institutions on the basis of partnership interaction, which should ensure the integration of joint activities in such strategic areas as: democratization of the activities of all state authorities and education management bodies at all levels, are characterized vertical management; decentralization and distribution of powers and obligations, joint responsibility for the management process and the result; involvement of various local governments in active participation in partnership interaction organizations and business structures; creation and organization of coordinated partnership activities of state management bodies and various public education management bodies, educational institutions that will present the entire public sector.
